In another twist on the 17 April 2024, Senior Magistrate at Nkowankowa magistrate court found that the court files were lost in a matter between Nkuna Traditional Council and Anold Ramoshaba in which Batlhabine Traditional Council was the second respondent.
The matter was on the stands belong to Mr Ramoshaba at Ventor Park in which such stands was issued and provided by Batlhabine Traditional Council on behalf of Ntona in the area. The Nkuna says the place is their own land of Sasekani while Batlhabine they own that land.
It was shock to discover that in the lower courts, although the courageous magistrate who preside on the matter adjouned the court proceedings to go a look for the file. Within three minutes the file was found in the clerk office.Â
The matter continues in which the attorneys representing Nkuna Traditional Council was unprepared and request for postponement, while the council representing Mr Ramoshaba and Batlhabine Traditional Council, argued that the matter was urgent, so the applicant cannot say they are not ready for the court, the presiding magistrate then ruled out that the matter be postponed with cost in favour of the Batlhabine Traditional Council.
